If you're someone who thinks they'll be in danger if they leave Canada, you might be eligible for Canada refugee program. Possible dangers that refugees might face include fear of physical torture, a potential threat to their life, or the risk of cruel punishment.

If you want to apply for a refugee settlement in Canada out of a fear of persecution, you first need a referral. You also need to meet the eligibility criteria before you get refugee status.

Referral

Potential refugees should either be referred by UNCHR (United Nations Refugee Agency), a private sponsorship, or by a designated organization.

For referrals, the person should be residing outside their home country and must meet all the requirements laid down by the UN Convention of 1951.

Eligibility Assessment

If you want to make a refugee claim, your case might be referred to the IRB (immigration and refugee board of Canada). The IRB acts as an independent dictation that decides individuals’ refugee and immigration status.

Under the following circumstances, a refugee claim might not be eligible:

If a person applying for a refugee claim is not eligible for Canadian immigration because of their criminal background or any violations of rights

If a person previously applied for a refugee claim but it wasn't found eligible

If a person previously applied for a refugee claim, but they were rejected

If a person had withdrawn or abandoned a refugee claim in the past

If a person is recognized by any other country as a convention refugee and they can return after that country

If a person is granted the status of protected person in Canada

If a person has already made a refugee claim in some other country

Admissibility Assessment

Once your application is approved by the visa officer, you must go through further screening, which includes:

· security screening

· criminal screening

· medical screening

Final Decision

Finally, if the CSIS approves your refugee status, you're granted a PR (Permanent Residence) status in Canada.
