Spousal Sponsorship Appeal: How to Apply?

You probably waited long and hard for your partner's visa approval, considering the current immigration backlog, so it's no wonder a sense of disappointment and panic overwhelms you if it's rejected. Every spouse visa application received by the Canadian government is accepted, but you may have the option to appeal if this happens.

How to Apply

The Immigration Appeal Division (IAD) deals with all kinds of immigration appeals. You can submit a sponsorship appeal with a brief explanation of why your claim should be accepted.

Who Can Appeal?

If your application was denied by Immigration, Refugees and Citizens Canada (IRCC), you could appeal to overturn a visa officer's decision if you're a permanent resident or citizen of Canada who applied for spousal sponsorship. However, you are unable to appeal if your partner is barred from entering Canada owing to a serious criminal matter, organized crime, human rights violations, or misrepresentation.

How Long Do You Have?

You have a timeframe of 30 days to file an appeal with the IAD from the day the application was denied. This will need to be accompanied by a fully completed Notice of Appeal form, along with a copy of the refusal letter from the IRCC.

Common Reasons for Refusal

Visa officers look to see if your and your companion's relationship is genuine. Make sure you submit an honest application to avoid room for any doubt. You must ensure that all documents are completed properly and that you have provided the correct supporting evidence with your application.
