A Guide to Spousal Sponsorship in Canada

Being away from your spouse can be challenging, and everyone understands how important it is for couples to be with each other. If your partner is in Canada, you may be able to be with them sooner than expected. There has been an overall increase in the number of spouse visa applications being processed by the Canadian government, and it doesn't seem like they're planning on slowing down any time soon.

Spousal sponsorship in Canada is a way for a permanent resident or citizen of Canada to sponsor their partner's immigration to Canada. Here is everything you should know about sponsoring your partner; in marriage, common-law or conjugal.

How to Apply

You can apply for sponsorship in one of two ways: inland or outland sponsorship.

Inland

The inland spousal sponsorship stream allows candidates to stay in Canada while their permanent residence application is being reviewed. You should apply for sponsorship under this stream if you reside in Canada with your partner, have valid immigration status, and want to apply for a work permit so you can continue working in the country while your spouse's immigration application is being processed.

If you do not have valid immigration status, you must apply for an extension or a new status document to keep your legal status in Canada while your sponsorship application is being reviewed. You will not be able to travel outside the country if you apply under this stream.

Outland

Outland spousal sponsorship allows a Canadian permanent resident or citizen to sponsor their partner regardless of where they are currently residing. Most applications are handled within 12 months as part of Canada's assurance of reuniting families swiftly.

While this program is intended for sponsored individuals who live outside of Canada, candidates who live in Canada may opt for outland spouse immigration because it allows them to travel in and out of the country while their application is being processed.

How Long it Takes

Sponsorship applications take around a year to process. They are normally handled in less than a year, although they can be slower, depending on the circumstances. Your case may be delayed if the details are complicated or the visa office demands extra documentation.

Make sure your application is reviewed and accepted promptly by completing it correctly the first time. Hiring an experienced immigration lawyer can increase your chances of a smoother immigration process.
