Immigration Lawyers vs. Immigration Consultants: What’s The Difference in Canada?

Immigrating to a new country can be a daunting and complicated process. Not only are there many documents you need to submit, but there are some other requirements you need to know about.

When you’re looking to immigrate to Canada, you have the option to choose a Canadian immigration lawyer or a consultant. Though both can represent you during the immigration process, they have starkly different backgrounds and authorities.

That's why today, we're listing all the differences between immigration lawyers and consultants.

Difference #1: Educational Backgrounds

Immigration lawyers or attorneys are required to obtain legal education experience compared to consultants. It's mandatory to attend law school for three years and pass the bar exam to become a registered lawyer. Additionally, many lawyers also work as interns in law firms either during or after their studies.

In comparison, immigration consultants are not lawyers as they don't attend law school. Instead, they get a one-year certification in order to become registered. Moreover, they also don't need to have an undergraduate degree to earn their certification. This also sets them apart from immigration lawyers who usually undergo several years of postsecondary education to enter law school.

Difference #2: Regulations and Verifications

Immigration consultants are licensed under the College of Immigration and Citizenship Consultants (CICC). The CICC monitors and audits them periodically. You can get verification of a consultant from the college’s website.

On the other hand, the CICC doesn’t regulate immigration lawyers. Instead, provincial law societies govern their practices.

Difference #3:  Advocating on Your Behalf

Immigrant lawyers in Canada are legally able to attend and help you through the process of your immigration interviews. In this way, they can also advocate for your application in courts of law on the perchance that your application comes under judicial review.

However, immigration consultants can’t advocate for your case in federal courts even if they can legally represent you.
